The increasing awareness of the need for an appropriate policy for the handling of personal information has led to the creation of a new area of legal expertise in order to provide direct advice to companies and self-employed professionals.
Organic Law 15/1999 (13th December) which covers the Protection of Personal Data, requires all individuals and companies handling personal information to fulfil certain legal requirements, such as establishing the corresponding security measures.
The legal services offered by the Department of Data Protection include:
- Detailed analysis of the legal situation regarding a company’s Data Protection policy.
- Completion of Notifications of creation for each individual file holding personal data and presentation of these to the Data Protection Agency in Madrid.
- Legal revision and audit of procedures and legal relations with third parties: Drafting of contractual clauses, legal notices, notifications and authorisations.
- Preparation of the Due Diligence Report and Recommendations.
- Drafting of the Security Document and mandatory Registers.
- Staff training and drafting of advisory letters and protocols to stimulate awareness of the various departments in the company.
- Audit to monitor the implementation of security measures as well as compulsory audits.
- Legal assistance in the case of possible inspections carried out by the Data Protection Agency.
- Legal assistance in the case of sanctioning proceedings.
